General Terms and Conditions (GTC)

1. Scope of application and contractual partners

  1. These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between the customer (hereinafter "Customer") and Sportini GmbH.  
  2. Customers can be both natural persons and legal entities. The GTC apply to natural and legal persons with residence, registered office or delivery address in Switzerland or the Principality of Liechtenstein.
  3. Sportini GmbH, based in 8588 Zihlschlacht, Haldenstrasse 5, acts as the contractual partner.

2. Offer and conclusion of contract

  1. The offers in the online store do not constitute a legally binding offer. The images and information on the products shown in the online store (lists of ingredients, nutritional information, food facts, allergy information, etc.) are for illustrative purposes only and are non-binding. The specific information on the product packaging is authoritative.
  2. An order placed by the customer is deemed to be an offer to Sportini GmbH to conclude a contract. An order shall only be deemed to have been concluded once the customer has selected the product in the online store and the payment method, confirmed these GTC and sent the order by clicking on the corresponding button.
  3. If the customer completes the order, he accepts the version of the GTC valid at the time of the order. Individual changes to the GTC are only applicable after mutual written confirmation in exceptional cases.
  4. If the customer completes the order, he/she also accepts and confirms the price recommended for the product or, if applicable, the product packages in the online store at the time of the order.
  5. The purchase contract between Sportini GmbH and the customer is only concluded after confirmation of the purchase by e-mail from Sportini GmbH in the form of the order or shipping confirmation. In exceptional cases, the purchase contract is only confirmed upon delivery of the goods. 
  6. If the purchase price of the product is paid by the customer in advance, the confirmation of payment by Sportini GmbH shall be deemed confirmation of the contract.
  7. Sportini GmbH is entitled to refuse orders in whole or in part without stating reasons. In this case, the customer will be informed and any payments already made will be refunded.

3. Prices and shipping costs  

  1. The prices in the Sportini GmbH online store include statutory VAT. All prices are quoted in Swiss francs (CHF).
  2. The prices quoted are exclusive of shipping costs.
  3. Sportini GmbH accepts the payment options shown in the purchase process.
  4. The purchase amount is due immediately upon conclusion of the contract.

4. Delivery conditions  

  1. Deliveries are only made to customers within Switzerland or the Principality of Liechtenstein. Exceptions must be agreed and confirmed in writing with Sportini GmbH in advance. The benefits and risks are transferred to the customer when the delivery is handed over to the forwarding agent.
  2. Delivery will be made to the specified delivery address within 1-3 days after conclusion of the contract. No deliveries are made on Sundays and public holidays.
  3. If a product or a partial order is not available, Sportini GmbH will inform the customer.
  4. Sportini GmbH is entitled to make partial deliveries.
  5. If the supplier has tried three times to deliver the product to the customer without success, Sportini GmbH reserves the right to withdraw from the purchase contract. Purchase price payments already made will be refunded. Sportini GmbH reserves the right to charge the customer for any shipping costs incurred in this case.

5. Warranty and right of return

  1. The customer is obliged to inspect the product for damage or defects immediately after delivery of the product from the carrier to the customer.
  2. The customer has 7 days from the date of shipment to complain about any damage to the product not caused by the customer, or other damage or defects not caused by the customer in connection with the product or the delivery, and to report them to Sportini GmbH. If the product shows damages or defects which are demonstrably not caused by the customer, the customer may withdraw from the purchase contract by written notice to Sportini GmbH within a period of 7 days after the date of shipment in the case of recognizable defects and immediately after discovery in the case of hidden defects and return the delivered products to Sportini GmbH. Products that fall into the category of dietary supplements can no longer be returned to Sportini GmbH for health reasons. Returns for other reasons are excluded.
  3. Complaints about the goods do not entitle the customer to withhold due payments.
  4. Sportini GmbH is not obliged to provide any further services after the expiry of the 7 days from the date of dispatch, subject to the provisions contained in point 5c.
  5. Returned products will be destroyed without exception for safety and hygiene reasons and will not be offered for sale again.
  6. As described in point 5b, the contract cannot be revoked outside of the points mentioned in point 5.
  7. Items from "Rotel" must be ordered directly from Rotel AG. Their warranty period of 24 months applies and begins on receipt of the products.

6. exclusion of liability  

  1. The carrier is responsible for damage and incidents that occur during the delivery of the goods to the customer. From the time of delivery of the product from the carrier to the customer, the customer is responsible for all damages incurred from then on. A right of withdrawal from the contract cannot then be asserted.
  2. The customer is obliged to inform himself about any incompatibilities. The customer is also obliged to check the product for any defects upon receipt.

7. data protection

9. final provision  

  1. Sportini GmbH reserves the right to adapt or amend these GTC at any time. Additional agreements or further commitments by Sportini GmbH must be made in writing.
  2. The legal relationship between Sportini GmbH and the customer shall be governed exclusively by Swiss law.
  3. Subject to mandatory statutory provisions, the parties agree that the courts of the Canton of Thurgau (Switzerland) shall have subject-matter jurisdiction
